Considering this is connected to Batman, do we feel sorry for the Batman character, Joker, because "he's insane"???
I expect his attorney will claim insanity. At that point the court will have Holmes take a bunch of psychiatric tests to determine if it's mentally competent (sane) enough to stand trial.
If he isn't, he'll be sent to a mental institute until such time that his trial can continue.
If he is found sane, he'll go on trial. Due to the sheer amount of evidence the state intends to bring against him the investigation, discovery, and other processes that need to occur mean the trial won't start until late 2013 - at the earliest. In the meantime, Holmes will be in jail, as he will not be offered bail.
The state prosecutors intend to ask for the death penalty, which is another reason why it's going to take so long to start the trial. The trial itself will take a long time as well. Even if he's found guilty and sentenced to death, don't expect a speedy execution. So long as he can file reasonable appeals, he cannot be executed.
Personally, I'd say skip the death sentence. It adds way too much overhead to the whole proceedings. Trials where the sentence is death as opposed to life-without-parole, are a lot a longer and more complicated.
Anyways I think this guy did it to get attention. The sooner we plop him into a cell and forget about him, the better. Even the death sentence is too good for him. Why give him a quick and painless death when that's not what his victims had. Killing Holmes won't bring them back to life or erase the physical and emotional pain the survivors are still suffering. If it's attention he wants, the best punishment is to NOT pay attention to him. Drop him a cell with a TV so he can watch as the rest of the world moves forward. His name quickly relegated to nothing but a anonymous footnote. Let him grow old and eventually die alone and unknown.

He definitely had some kind of issues, but whether they find him innocent by way of insanity, or reject an insanity plea and find him guilty - he's going to either be in an maximum security asylum or prison.
He won't be seeing the outside for a loooooong time. If ever.
I think he should be tried just like all other people who would do such a thing. Anyone can just plead insanity and get away with it. I think it's unfair to the families who had to go through such horrible things, that they wouldn't get to see justice done to their killer.
There's a debate going on at home about the man who is responsible for the shooting of the aurora movie theater. Some ppl say that they feel sorry for him because they don't think he was sane.
